Legality of Invisible Monsters face

I would have posted this on the IM forum, but its locked for some loveable, odd reason.
That flip-face on the cover, I don't know if its copyrighted or who owns it, but I was at the Hopkinton State Fair today in Hopkinton, NH, and some dude who owned a stupid sign stand had a sign of the face, the ugly side saying 'before beer' and the flipped, pretty side saying, 'after beer', or some cheesy phrase like that. Was that artwork done for the book, does someone own it, is that legal to sell, etc?
I checked the sign for copyrights or anything, there was nothing besides the image and the phrase.

That's a famous optical illusion. Not sure of the creator.

Yeah, that picture has been around for quite some time. The Invisible Monsters cover, unfortunately, isn't the first use of the image.
