Tito Ortiz Using Fight Club Cover Art...Legally?

Anyone know if the graphic for Tito Ortiz's fan club was legally obtained? It is obviously  the cover artt from Fight Club.

that image had become so iconic that unless he's using it to make money I doubt there's anything to be done.

Well given that he is using that image to market himself by tying himself to Chuck's work I would imagine that a C&D would solve the problem.  I mean shit he just had someone paste text over the bar of soap.  Fucking thief.  I actually found someone doing the same kind of thing with Coop's work and it miraculously vanished soon after I let them know.  I just hate seeing shitbags riding the coat tails of artists I respect.

Making money is nothing to do with the fair use law; if it's defendable as a parody or has creative merit by itself, then it's cool. That image is, yes, iconic, and well defendable as a parody. As far as American law goes anyway, which is pretty much all that matters when dealing with the internet.

Ehh, I don't think anyone's gonna think the Fight Club symbol was based off of the 'Tito Ortiz Fan Club' symbol. If anything he's giving publicity to FC, the only thing I worry about is meatheads associating FC with UFC and all its drama, but that's inevitable.
